An enduring power of attorney lets someone you trust make decisions for you if you can't. This guide covers how it works in Queensland. For the general picture across Australia, see our guide to enduring power of attorney.
The forms
Queensland has approved forms: Form 2, the short form, and Form 3, the long form. Read the Form 9 explanatory guide before you begin. You can fill the form in by hand or on a computer. The forms are available free from the Queensland Government website, and you can print them at your local library or a print on demand service.
Queensland also has a separate Advance Health Directive form for your health care wishes. See our guide to advance care directives.
Signing and witnessing
You must sign your enduring power of attorney in front of an eligible witness. That can be a justice of the peace (JP), a commissioner for declarations, a lawyer or a notary public. The witness signs the form, and then each attorney signs the acceptance section of the original form.
Registering for land
Your enduring power of attorney doesn't have to be registered to be valid. But before your attorney can deal with land in Queensland on your behalf, it must be registered with the Queensland Titles Registry, by lodging a Form 16 with a certified copy.
Changing your mind
You can revoke (end) your enduring power of attorney at any time while you have capacity, using the Revocation of Enduring Power of Attorney form (Form 6).
After it's signed
Once it's signed, keep the original somewhere safe, give copies to the people who may need them, and write down where the original is kept. Our guide to storing important documents has more on this. If your situation is complicated, or you're not sure which document you need, a solicitor can help.
